What is Emigration?

Definition of Employment Under Emigration Act

Employment refers to any service or occupation for wages (excluding government jobs), including:

  • Unskilled labor (industrial or agricultural)
  • Domestic work
  • Non-managerial roles in hospitality
  • Drivers, mechanics, technicians, artisans
  • Clerical jobs (typists, assistants, accountants)
  • Entertainment or cinema-related jobs

What is Emigration Clearance?

Emigration Clearance (EC) is a legal authorization issued by the Protector of Emigrants (POE), required by ECR passport holders intending to work in ECR countries. The clearance is granted in the form of a security sticker placed on the passport.

Who Requires Emigration Clearance?

Individuals with ECR stamped passports (typically those without a matriculation certificate) must obtain emigration clearance before traveling for employment to ECR countries.

What is ECNR?

ECNR (Emigration Check Not Required) status exempts the holder from needing Emigration Clearance. This applies to educated individuals or those in exempted job categories.

Documents Required for Semi-Skilled Workers (Individual)

  • Valid passport (minimum 6 months validity)
  • Valid visa
  • Employment contract attested by the Indian Mission in the destination country

Documents for Unskilled Workers & Female Domestic Workers

Women (above 30 years) and unskilled domestic workers must present:

  • Valid passport and visa
  • Employment contract
  • Medical clearance and other required papers

Documents Through Recruiting Agents

Recruiting agents must ensure employment contracts are attested by the Indian Embassy and provide all necessary documentation based on the worker’s skill level.

What is ECR Suspension (ECRS)?

The ECRS system, used earlier for non-employment travelers with ECR passports, has been discontinued as of October 1, 2007.

Pravasi Bharatiya Bima Yojana (PBBY)
